Yavelin Fernandez, 28, of Homestead, was arrested on Sunday and charged with one count of felony child neglect in the second degree, according to Monroe County Sheriff’s Office online booking records.

According to sheriff’s office spokesperson Adam Linhardt, deputies responded to the Gilbert’s Resort in Key Largo, the Miami Herald reported.

Security video footage from the resort showed the girl and a 5-year-old boy alone by a pool, according to the newspaper. The girl apparently fell into the pool, and a guest at the resort pulled her out of the water, the Herald reported.

Deputies said the girl was not wearing a flotation device, and security video shows that she appeared to be drowning, WSVN-TV reported.

According to a police report, the girl had “red skin, red, watery eyes and (was) coughing up water,” WPLG-TV reported.

Deputies were able to locate Fernandez at about 6 p.m. EDT after a brief search, according to the television station. According to the sheriff’s office, Fernandez appeared to be intoxicated.

“Fernandez was belligerent and yelling at deputies,” Linhardt said, according to the Herald.

Fernandez was arrested and booked into the Monroe County Jail, where she remained on Monday, online records show.

She is expected to appear in court on May 2, online booking records show.
